1. Introduction

Welcome to Garder, a community finance, wallet, support, savings, and trust platform operated by Hustle 360 Ltd. Garder includes Community+, Circles, Susu, Funds, Wallet, support plans, and trust-history features ("we," "us," or "our"). By accessing or using Garder (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Platform.

Garder is not a bank, deposit-taking institution, investment adviser, or traditional loan provider. The Platform provides technology that helps users request structured support, give structured support, participate in community savings-style features, manage wallet activity, and build trust history.

2. Definitions

  • "Supporter" – A user who gives structured support, backs a Fund, participates in a Circle/Susu, or otherwise commits funds through the Platform.
  • "Member requesting support" – A user who requests support, creates a Fund, joins a Susu, receives a wallet payout, or receives support through a support plan.
  • "Support Plan" – A user-to-user support arrangement facilitated by the Platform with disclosed amount, return amount or return rate, schedule, wallet movement, and terms.
  • "Fund" – A community-backed goal where supporters can make offers and the creator can accept selected support terms.
  • "Susu" – A rotating savings-style cycle within a Circle where members contribute and receive payouts according to disclosed rules.
  • "Circle" – A community group where approved members may participate in support, savings, accountability, and trust-building activities.
  • "Trust Score" or "Trust Indicators" – A numerical, badge-based, or summary representation of platform behavior, including completed commitments, wallet activity, support-plan history, Fund/Susu activity, verification status, and missed commitments.

3. Platform Role & Limitations

Hustle 360 Ltd provides technology, wallet, community, recordkeeping, and trust-history tools. We do not act as a bank, deposit-taking institution, investment adviser, or traditional loan provider. User-to-user support arrangements are created by users and accepted by users.

3.1 What We Do

  • Provide a platform for users to request support, give support, create Funds, join Circles, run Susu cycles, and use wallet features
  • Track support-plan agreements, wallet actions, payment schedules, transaction history, and platform commitments
  • Calculate and display trust scores, badges, or trust indicators based on platform behavior
  • Facilitate payments through third-party payment processors
  • Send reminders and notifications about upcoming returns, wallet actions, account security, Circle/Susu activity, and platform activity
  • Provide support tools, reporting tools, account-safety tools, and dispute-review tools where available

3.2 What We Do NOT Do

  • Act as a bank, deposit-taking institution, investment adviser, or traditional lender
  • Guarantee any support plan, Fund, Susu, return, payout, member behavior, or user commitment
  • Provide financial, legal, investment, or credit advice
  • Guarantee user identity, income, trustworthiness, or ability to complete commitments
  • Pursue legal action on behalf of users unless we choose to do so to protect the Platform or our own rights
  • Insure or protect users against missed commitments, failed returns, failed Susu contributions, payment-processor issues, or Fund losses

4. User Responsibilities

4.1 Account Registration

You must provide accurate, complete, and current information during registration and while using the Platform. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

4.2 Identity Verification (KYC)

We may require identity verification using your National Identification Number (NIN), Bank Verification Number (BVN), date of birth, phone number, or other verification details. Verification helps prevent fraud, protect users, satisfy payment-partner requirements, and comply with applicable law.

4.3 Supporter Responsibilities

  • Review all support terms, return expectations, fees, schedules, user history, and trust indicators before committing funds
  • Understand that support plans, Funds, Circles, and Susu cycles carry risk and may not be completed as expected
  • Only commit funds you are comfortable putting at risk
  • Set fair, lawful, clearly disclosed, and platform-compliant terms
  • Comply with all applicable laws and platform rules
  • Use reporting and dispute tools responsibly and honestly

4.4 Member Requesting Support Responsibilities

  • Review and accept only terms you understand and can realistically complete
  • Complete support-plan returns, Susu contributions, Fund commitments, or other platform commitments according to accepted terms
  • Maintain accurate contact, wallet, bank, and verification information
  • Communicate proactively if you cannot complete a commitment on time
  • Understand that missed commitments may affect your trust score, badges, profile visibility, access to support, and future participation
  • Use the Platform honestly and avoid misleading supporters, Circle members, Fund participants, or Garder

5. Trust Score & Trust Indicators

Your trust score, badges, or trust indicators on Garder may be calculated based on:

  • On-time completion of support-plan commitments
  • Wallet activity and transaction history
  • Number of active support plans, Funds, Susu commitments, or other obligations
  • Missed commitment history
  • Length of account history
  • KYC or verification status
  • Community behavior, reports, disputes, and platform-safety reviews

Trust scores, badges, or trust indicators may be visible to other users to support informed participation. Scores and indicators may update automatically as you use the Platform and may be adjusted if fraud, abuse, disputes, or system errors are detected.

6. Prohibited Activities

You may not use the Platform to:

  • Engage in fraud, deception, identity misuse, scams, or money laundering
  • Provide false, misleading, or incomplete information
  • Impersonate another person or create unauthorized accounts
  • Set unlawful, abusive, hidden, predatory, or misleading terms
  • Use the Platform for commercial financial services without proper authorization or licensing
  • Harass, threaten, shame, dox, blackmail, or abuse other users
  • Attempt to manipulate trust scores, wallet records, Susu records, Fund records, reviews, reports, badges, or platform history
  • Create multiple accounts to bypass limits, suspensions, KYC, wallet holds, or platform restrictions
  • Upload malware, harmful files, illegal content, or content that violates another person’s rights
  • Interfere with the Platform’s security, payment processing, wallet records, or technical infrastructure

7. Wallets, Payments & Fees

We use third-party payment processors, which may include Flutterwave, Paystack, Monnify, or other providers, to facilitate wallet credits, withdrawals, payouts, support-plan returns, Susu activity, Fund activity, and transaction status checks. By using payment features, you agree to comply with applicable payment-partner terms and requirements.

We may charge transaction, processing, service, or platform fees for certain wallet actions and platform features. Applicable fees will be displayed before you confirm the relevant transaction where required.

Wallet balances, payment references, and transaction statuses may be delayed or affected by payment processors, banks, network providers, fraud reviews, compliance checks, or technical issues.

8. Risk, Liability & Disclaimers

STRUCTURED SUPPORT, FUNDS, CIRCLES, SUSU CYCLES, WALLET ACTIVITY, AND USER-TO-USER COMMITMENTS CARRY RISK. USERS MAY MISS COMMITMENTS, DELAY RETURNS, DISPUTE TERMS, OR FAIL TO COMPLETE EXPECTED ACTIONS.

  • Missed commitments, delayed returns, failed contributions, or non-completion by users
  • Loss of funds, expected returns, anticipated payouts, or expected benefits
  • Accuracy of user-provided information
  • Disputes between users, supporters, Fund creators, Circle members, or Susu participants
  • Third-party payment processor, bank, or network failures

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, HUSTLE 360 LTD SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM, YOUR PARTICIPATION IN USER-TO-USER SUPPORT ARRANGEMENTS, OR YOUR RELIANCE ON TRUST INDICATORS.

9. Disputes, Reports & Support Review

Disputes between users should first be addressed through platform communication, reporting, and support tools where available. We may review reports, suspicious activity, or disputes, but we are not obligated to resolve every dispute or guarantee any outcome.

We may suspend accounts, restrict wallet activity, apply holds, limit features, adjust trust indicators, or take other reasonable action where we suspect fraud, abuse, policy violations, payment issues, or risk to users or the Platform.

10. Account Suspension & Termination

We may suspend, restrict, or terminate your account if you:

  • Violate these Terms or other Platform rules
  • Engage in fraud, abuse, harassment, manipulation, or suspicious activity
  • Fail to complete required verification
  • Have unresolved disputes, wallet issues, chargebacks, suspicious payment activity, or missed platform commitments
  • Create risk for other users, payment partners, Hustle 360 Ltd, or the Platform

Account deletion requests may be subject to legal, compliance, fraud-prevention, KYC, wallet, payment, dispute, and transaction-record retention requirements.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes via email, in-app notification, or by posting the updated Terms. Continued use of the Platform after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, unless another jurisdiction is required by applicable consumer, payment, or data-protection law. Any disputes arising from these Terms shall be handled by competent courts or authorities with jurisdiction.
